Frank Zappan perikunnan oikeusdraama jatkuu: lue Dweezil Zappan vastaus veljelleen Ahmetille

Uutisoimme toukokuun alussa Frank Zappan perikunnan oikeusriidoista. Kitaristi Dweezil Zappa kertoi joutuvansa maksamaan huomattavia korvauksia, mikäli haluaa jatkaa esiintymistään Zappa Plays Zappa -nimellä, mutta hänen veljensä Ahmet kumosi muun muassa tämän väitteen julkaisemassaan julkisessa kirjeessä. Dweezil on nyt vastannut tähän kirjeeseen.

Dweezil syyttää veljeään ristiriitauksista ja siitä, ettei tämä kerro koko totuutta, ja toteaakin tekojen puhuvan sanoja enemmän. Hänen mukaansa Ahmetin kirjeessään esittämä sopimus yhden dollarin vuosimaksusta Zappa Plays Zappa -tribuuttiesitysten esittämisestä on täysin keksitty, ja todellisuudessa Frank Zappan musiikkia ja oikeuksia valvova Zappa Family Trust on rikkonut esityksistä saatuja tuloja koskevaa sopimusta. Lasten edesmennyt Gail-äiti jätti elinaikanaan johtamalleen järjestölle miljoonavelat ja pyrki omistamaan kaiken kuolleeseen mieheensä liittyvän, päätyen lopulta patentoimaan jopa tämän viiksimallin. Dweezil itse kertoo:

”Unfortunately your actions speak louder than the words you’re using to spin this. You have demanded that the ZFT would take 100% of the tour merchandise revenue.

”In a little twist, you have suggested that after the trust pays off its debts, then I would receive my 20% share of what is left over – a mere fraction of what I am owed per the contract. This non-negotiable demand that I am solely responsible for all touring and rehearsing expenses, yet will receive 0% of the tour merchandise – and no retroactive payments of merchandise money that the trust has owed me since 2006, all in exchange for paying $1 for the license to use the name Zappa Plays Zappa – is not a deal.

”If this proposition wasn’t so laughable, I’d consider it an insult. Your $1 deal to use the name but take all of the merchandise is unacceptable.

”If I was to tour under the name Zappa Plays Zappa and not pay you 100% of the merchandise money, you threatened to sue me for copyright infringement of $150,000 per musical infraction. The deal you keep referring to is one that I had already rejected as being ludicrous and unfeasible.”

Tuekseen väitteilleen Dweezil julkaisi Ahmetin lakimiehen lähettämän kirjeen sisällön:

”In light of the foregoing we hereby advise you that should your client proceed to perform under, or advertise, or otherwise use the name ZPZ or Zappa Plays Zappa or to use the same in connection with any such performances my client will pursue its rights to prevent such performance and usage as the exclusive owner of these trademarks. Further, your client cannot perform a show consisting largely of Frank Zappa’s work because ASCAP is not authorized to grant a performance license for such kind of performances, and the ZFT will not grant such a license except on the terms outlined to Mr. Waring which your client has rejected. Any public performance of Frank Zappa’s works as part of the ZPZ show using the music of Frank Zappa without a license from ZFT constitutes copyright infringement and will be prosecuted by ZFT. A willful infringement of copyright can result in damages of up to $150,000 per infringement, plus attorney’s fees and a possible injunction.”

Dweezil kertoo myös hänen ja siskonsa Moonin kummankin omistavan 20% Zappa Family Trustista, kun taas heidän järjestöä johtavien sisarustensa Ahmetin ja Divan omistusosuus on 30% henkilöä kohden. Näin ollen Ahmet ja Diva hyötyvät automaattisesti Dweezilia enemmän tämän tribuuttikonserteista. Hän myös ihmettelee, miksi joutuu perheenjäsenenä maksamaan järjestölle mittavia korvauksia, kun samalla täysin ulkopuolinen Alex Winter ei maksa tulevasta Frank Zappa -elokuvastaan yhtikäs mitään. ”What quality control standard are we as the Zappa family to expect from this project? Our father was all about integrity, and without being given any information from you or Diva, I find this to be very confusing.
